Delegations of Authority

Under Secton 377 of the Local Government Act 1993, a council may, by resolution, delegate to the general manager or any other person or body certain functions of the council. The general manager may sub-delegate under Section 378(2) of the Local Government Act, a function delegated to the general manager by the council to any person or body (including another employee of the council).

The General Manager has delegated those matters set out in Moree Plains Shire Council’s Delegations Register.

This Delegations Register is to be read in conjunction with Council's Policies and Procedures as well as relevant Acts and Regulations.

 

 

Policies

A Council Policy expresses our position on a particular issue or subject. It records the ‘why’ and ‘what’ of Council decision making.
We have many responsibilities and perform many tasks to maintain and improve the Moree Plains Shire and make it a great place to live, work and play.

Policies are essential to ensure that legal, fair and consistent decisions are made across Council. They support Council in achieving its corporate objectives and provide crucial guidelines for Councillors, staff and other stakeholders. Without sound policies there is a greater risk of inconsistency, confusion and inefficiency.

Accessing Council Information

Government Information (Public Access) Act 2009 (GIPA Act)

The aim of the GIPA Act is to provide an open, accountable, fair and effective government. This means that government agencies in NSW are being required to make more information freely available and more processes and documents of Government will be available following an application process.

The GIPA Act applies to all NSW government agencies, including local councils. It requires proactive information disclosure through mandatory publication and authorised release of open 'access information’. The Act also provides for disclosure in response to informal requests and a revised system of response to formal access applications.

Council’s Agency Information Guide allows the public to identify and access government information held by the Council. It contains information about the structure of Council, the functions we are responsible for and how to access the information we hold. You can find Council’s Agency Information Guide here.

There are four ways to access Council information:

Mandatory Release

You can search our website. Certain information must be disclosed on Council's website, free of charge. This includes our policy documents, current publication guide, disclosure log and register of government contracts.

You can review GIPA Act Current Contracts awarded valued at or worth more than $150,000.

Annual Written Returns for Councillors and Designated Persons

Pursuant to Part 4 of Council’s Code of Conduct, Councillors and designated persons must make a written annual declaration to the General Manager within three months after:

  • becoming a Councillor or designated person; and
  • 30 June of each year; and
  • the Councillor or designated person becoming aware of an interest they are required to disclose that has not been previously disclosed.

The individuals who hold the following positions during the relevant year are deemed to be designated persons:

The annual returns are tabled at the Ordinary Council Meeting held in October.  In accordance with the Government Information (Public Access) Act 2009 (NSW) (GIPA Act), the annual returns are made publicly available on Council’s website.  Personal information has been redacted from the returns in accordance with the GIPA Act.

Proactive Release

You can ask us what information we will make available to the public, in addition to the information contained on our website. We are encouraged to release as much government information as possible, in an appropriate way and free of charge (or at the lowest reasonable cost).

Informal Request

You can ask for specific information by contacting Council's Customer Service Team on (02) 6757 3222. We are encouraged to release information without the need for a formal access application.
Informal GIPA Application

Formal Application:

If you can’t otherwise access your required information, a formal access application under the GIPA Act may be necessary. This might, for example, be needed for large volumes of information that involve extensive searches of Council records or information in relation to third parties which must be consulted prior to release.

As set out in Council’s fees and charges, an application fee applies as well as processing charges.

Council Financial Assistance

Council is permitted to contribute money or otherwise grant financial assistance to persons for the purpose of exercising its functions.

Due to limited funding available within Council’s budget, Council seeks to provide funding to only those individuals or organisations that provide the most benefit to the community, and the funding is utilised for purposes that support, and are consistent with the Council’s Community Strategic Plan.

Council provides two opportunities for financial assistance under the Public Donations Fund and the Community Enhancement. Community, sporting, and educational groups wishing to apply for financial assistance from Moree Plains Shire Council for events, functions, and sponsorship are encouraged to apply.

Public Donations

Under the Public Donations fund, Council will consider eligible applications for financial assistance at its first meeting in each financial quarter except in the first quarter of each calendar year, when it may be considered at the first or second meeting of Council.

All applicants are required to complete and submit a Public Donations Application Form to enable the application to be considered. A maximum of $3,000 is available under this fund.

Community Enhancement Fund

Thanks to an annual financial contribution from the Moree Solar Farm Pty Ltd the Council is able to, in accordance with a resolution of the Council, contribute money or otherwise grant financial assistance to groups or organisations.

Under the Community Enhancement Fund, the Council will consider eligible applications for financial assistance at its first meeting in the April to May financial quarter per calendar year. All applicants are required to complete and submit a Community Enhancement Fund Application Form to enable the application to be considered. A minimum of $5,000 and a maximum of $25,000 is available under this fund.
